User Agreement

Welcome to Kofii (“App”), an AI character dialogue application operated by us (“we,” “our,” or “us”). This User Agreement (“Agreement”) sets forth the terms and conditions that govern your use of Kofii. By downloading, accessing, or using the App, you agree to comply with and be bound by this Agreement. If you do not agree, you may not use the App.

1. Eligibility
You must be at least 18 years old to use Kofii. By using the App, you represent and warrant that you meet this age requirement.

2. Use of the App
You may use Kofii for personal, non-commercial purposes only. You agree not to:

• Use the App for any unlawful, harmful, or abusive purposes.

• Create or share content that is obscene, defamatory, hateful, or infringes upon the rights of others.

• Reverse engineer, decompile, or attempt to extract the App’s source code.

• Interfere with or disrupt the App’s operation or security.

3. User-Generated Content
Kofii allows you to create and customize AI characters, including setting images, nicknames, and personal descriptions. You retain ownership of the content you create but grant us a worldwide, non-exclusive, royalty-free license to use, display, and store such content as necessary to operate and improve the App. You are solely responsible for the content you create and share.

4. Intellectual Property
All rights, title, and interest in and to the App, including but not limited to software, design, text, graphics, and trademarks, are owned by us or our licensors. Except as expressly permitted in this Agreement, you may not copy, modify, or distribute any part of the App.

5. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

6. Termination
We reserve the right to suspend or terminate your account or access to the App at our sole discretion if you violate this Agreement or engage in behavior we deem inappropriate or harmful.

7. Disclaimers
The App is provided “as is” without warranties of any kind, whether express or implied. We do not guarantee that the App will be error-free, uninterrupted, or meet your expectations. AI-generated content may not be accurate or reliable, and you should not rely solely on it for decision-making.

8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to loss of data, loss of profits, or personal injury.

9. Changes to the Agreement
We may update this Agreement from time to time. If we make material changes, we will update the “Last Updated” date above. Continued use of the App after such updates constitutes your acceptance of the revised Agreement.

10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which we are established, without regard to conflict of law principles.
